Advice to the City of New York: You may need to call 1-888-Call-Sam to settle this thing.

Attorney Richard Bernstein, son of the locally famous Sam Bernstein, plans to file a lawsuit in Michigan today suing the city of New York to make pedestrian walks safer at Central Park where he was hit by a bicyclist in August while walking, the New York Daily News reports.

The paper said he the suit will allege that the city is violating the Americans with Disabilities Act by failing to stop reckless bikers.

Bernstein, who is blind,  broke his hip and pelvis and has been in Mount Sinai Medical Center in New York since Aug. 13. The bicyclist was going about 35 mph.

The paper reports that he's not seeking a dime in damages or legal fees.

“This happened for a reason,” Bernstein, 38, told the paper. “We are going to make this park safe.”

The Daily News wrote: 

Bernstein was training for his 18th marathon in Central Park when he was hit by a bike going 35 mph — 10 miles over the limit. It happened just days after the Daily News documented a slew of cyclists going too fast in the park.

The paper noted that police have handed out fliers reminding bikers of the park rules, but Bernstein thinks that's inadequate.

“They have not made any substantive changes,” he told the paper. “Handing out leaflets? That’s your solution?”

Interestingly, Bernstein has said he won't sue the biker who hit him and apologized.
