The original Joe Muer's restaurant on Gratiot in Detroit opened in 1929 and closed in 1998. In 2011, it reopened in the RenCen in downtown Detroit as Joe Muer Seafood.

The owner, restaurateur Joe Vicari, has gone to court to protect the name.

On Friday,  Macomb County Circuit Court judge issued a preliminary injunction preventing a soon-to-be-opened seafood restaurant in Clinton Township from using the Joe Muer name, reports Mitch Hotts of The Macomb Daily.

The ruling leaves in doubt the  future name of the restaurant at Partridge Creek, which was set to open in coming weeks as Muer Table + Bar.

"The court is persuaded this factor [intent to confuse the public[ weighs heavily in favor of a finding of confusion,”  Judge Kathryn Viviano's opinion says.
