Kim Mathers

A judge Thursday rejected Kim Mathers' bid to have her drunken-driving charge dismissed based on issues over her blood test. 

Last October, Mathers, 41, the ex-wife of Eminem, drove a Cadillac Escalade into a utility pole at 23 Mile Road and Card in Macomb Township last October, according to coverage in The Macomb Daily.  She told police she drank “like a fifth” of Malibu rum and deliberately crashed the vehicle in hopes of killing herself. 

Jameson Cook of the Macomb Daily reports that Judge Douglas Shepherd of 41A District Court in Shelby Township rejected legal efforts to invalidate the search warrant that produced a blood-alcohol test. A pretrial hearing is set for June 13 and a trial on July 20.

Her attorney, Michael Smith, had raised several objections about the blood test.

In a legal motion, Smith argued that a legal error was committed when a police officer who referred her for a psychiatric evaluation gained consent for the blood draw to test her blood-alcohol level, the Macomb Daily reported.

“I think that’s a little too much,” he said after the hearing, the paper reported. “I think you’re going to find a lot of people who say that isn’t good consent.”
