A defense attorney for the Dearborn Heights man charged with fatally shooting Renisha McBride, 19, on his porch, wants to introduce "selfies" of the victim with marijuana, alcohol and a gun, WWJ reports.
But the radio station reports that Wayne County Circuit Judge Dana Hathaway ruled Monday at a pretrial hearing that the photos aren't admissible under Michigan law. The attorney for Theodore Wafer, 55, says the photos show the woman had a "character trait" for violence and aggression.
The prosecution disagrees.
“Just because it’s on your phone, doesn’t say anything about who you are as a person,” said assistant prosecutor Danielle Hagaman-Clark on Friday, according to WWJ.
Wafer claims he shot the woman in self defense.
