The U.S. Department of Justice has decided not to file criminal charges against the Macomb County Jail or medical staff in the death of a 32-year-old Roseville man who died in custody at the jail in 2014, the Macomb Daily reports. The inmate was serving a 30-day careless driving sentence.
Federal authorities last week sent letters to county officials and the family of David Stojcevski, 32, who died in a hospital shortly after being released from a 17-day stay at the jail, writes Jameson Cook of the Macomb Daily. Jail video over that period showed him in apparent states of ill health and naked before he was transported to a hospital, and WDIV reports that he lost nearly 50 pounds in 17 days.
“After a thorough and exhaustive review of all the facts relating to your son’s death, we have determined that the evidence does not support a federal civil rights prosecution,” says a letter to the Stojcevski family, according to the Macomb Daily. “The federal criminal civil rights statutes that we enforce carry a very high burden of proof that cannot be met in this case. Specifically, the available evidence is insufficient to prove beyond a reasonable doubt that the deputies and medical personnel who were responsible for the care of your son acted with requisite criminal intent.”
The family is still suing the county.
