Size really does matter, according to a story about a topless club in Warren by the Detroit Free Press.
Reporter Tresa Baldas writes that Jon Jon's, Warren's last standing gentlemen's club, is battling to re-open. The city claims that when it renovated the joint, it made it too big and "added gizmos like pillars with shooting flames."
Baldas writes:
The club argues that city officials engaged in a “racial smear campaign” to shut it down — a stop-work order was issued in 2010 — and that its constitutional rights have been violated in the process.
The dispute has wound its way through local, state and federal courts in the last three years, with the city winning nearly all the rounds.
The Freep reports that last week the club scored a victory of sorts. The U.S. Sixth Circuit Court of Appeals ruled that a lower court erred in dismissing the club’s constitutional claim, and remanded the case back to the U.S. District Court in Detroit for further review.
The Freep reports that the club is seeking damages because of the city's interference in operating it, and wants to continue renovations.
The club's attorney Vincenzo Manzella says the club can adjust to satisfy the city.
The Freep writes:
If it’s really about size, the attorney said, the club can always get smaller.
