Judge Diane Hathaway walks out of court in January 2013.

The message was simple: Sorry judge, you're not getting out of Camp Cupcake early.

U.S. District Judge Corbett O'Meara on Tuesday issued a written ruling denying a request by disgraced ex-Michigan Supreme Court Justice Diane Hathaway that she serve out the remainder of her 1 year prison term in home confinement or get out early. Her release date is  June 26.

Hathaway is currently being housed in the Alderson Federal Prison Camp in West Viriginia that has been dubbed "Camp Cupcake" because of its cushy environment. Martha Stewart and Monica Conyers are former alum of the minimum-security camp.

Hathaway was sentenced last year to 1 year and 1 day in prison for bank fraud. She was convicted of hiding assets so she could get a short sale on her lakefront home in Grosse Pointe.

Hathaway, in a filing on Jan. 13, noted that the prison system was treating her differently than other inmates. She wrote that the prison system was not going to allow her to transfer to a halfway house for safety reasons because of her position as a former sentencing judge. She also noted that under  the current arrangement,  she could only serve 10 percent of her sentence in home confinement.

That being said, she suggested her sentence be modified so that she could serve more of her time in home confinement, or that the judge end her prison term early.

She wrote in her court filing:

"Defendant hereby respectfully prays that this Honorable Court split her sentence so that the last six months be served on home detention or alternatively, reduce her sentence by 6 months in light of her post conviction rehabilitation programming."

But Judge O'Meara's ruling said:

"Defendant moves for a modification of her sentence, requesting that the court order the Bureau of Prisons to place her in a residential reentry center and/or reduce her sentence based upon post-sentencing rehabilitation. Neither of these grounds provides a legal basis for the court to modify her sentence."'

In her filing, Hathaway included "Certificates of Achievement" in prison showing that she had 'satisfactorily completed":

  • Sweating to the Oldies
  • Church of Christ Study
  • Jewish Study
  • Women's Aglow
  • Sunset Yoga
  • Briskwalking 500 Miles
  • Nutrition
