A 30-year-old Detroit security guard has been cleared in the fatal shooting on Tuesday of a suspected thief, but faces a charge of unlawfully carrying a concealed weapon, the Wayne County Prosecutor's Office announced Friday.

Dominique Davis of Detroit was working as a security guard in the 260 block of Merton in Detroit around 4:30 p.m. when she spotted Melvin Johnson, 52, of Detroit, stealing building materials from the location and loading them into his truck, according to a press release by the Wayne County Prosecutor's Office.

Davis blocked Johnson's truck in with her car, and after a heated conversation, Johnson agreed to let her retrieve the stolen good from his truck.

But when she attempted to retrieve the items, Johnson put the truck in reverse and drove in Davis' direction,  authorities allege.  Davis then fired  her handgun one time, wounding Johnson in his right shoulder area.  He was taken to the hospital where he was pronounced dead.

Authorities said Davis immediately called police and waited until they arrived at the scene.

"Based upon a  thorough review of the evidence, it has been determined that Davis acted in lawful self-defense," the prosecutor's office siad. "Under the law of self- defense, a person must have an honest and reasonable belief that the use of deadly force was necessary to prevent imminent death or imminent great bodily harm.  In this case, based upon a thorough review of the evidence, it has been determined that Davis’s acted in lawful self- defense."

But Davis didn't have a permit for a gun and will face charges for that, authorities said.
