The attorney for former Tigers pitcher Evan Reed is trying to block the courts from trying his client on rape charges.
Ben Gonek has filed an appeal with the Michigan Court of Appeals in an attempt to dismiss the charges stemming from an encounter Reed, 28, had with a 45-year-old woman at the Motor City Casino hotel last spring, WWJ reports.
Last November, Detroit 36th District Court Judge Kenneth King tossed the rape charges, saying the alleged victim lacked credibility. Wayne County Circuit Judge Michael Callahan reinstated the charges after the prosecutor's office appealed.
Gonek says Callahan's decision was plain wrong.
“Usually when a judge does that (reinstates charges) they give an analysis of their decision — why the judge was wrong, or why the lower court judge was wrong,” said Gonek, according to WWJ.. “In this case, that didn’t happen. There was no clear analysis.”
